LOGISHAR Privacy Policy

PLEASE NOTE: by using the Services you acknowledge and agree that all personally identifiable information ("Personal Info") that you submit or that is collected through the Services may be processed by LOGISHAR in the manner and for the purposes described in the following Privacy Policy.

As part of our policy, to provide our Services in an honest and transparent way, we wish to inform you about certain types of information we gather about our users for the purpose of providing our Services. In addition, as part of its services to its Users, LOGISHAR may have access and/or may receive users' information which may include personal information, and therefore is referred to as a processor of Personal Info. For that reason, LOGISHAR feels you should fully understand our policy and the terms and conditions surrounding the capture and use of that information. This policy applies to all of the software, services, web based application, information, tools, hardware, features and functionality available on the Services and covers how Personal Info that LOGISHAR may process, including in respect of any use of the Services, is treated. You may be a User as defined under the Terms of Use, which are available here, (the “User”) or a User’s authorized user (the “Authorized User”) or a visitor at LOGISHAR’s website (the “Visitor”).

1. INTRODUCTION

This Privacy Policy applies whenever you access any of LOGISHAR's Services, from any device and software (whether web software or mobile app (the “Platform”). Any terms not defined in this Privacy Policy shall be given the meaning ascribed to them in the Terms of Use.

2. DATA WE COLLECT AND HOW WE COLLECT IT

    2.1 General

    As part of providing the Services, LOGISHAR will process Personal Info to the                extent necessary for providing the Services.

 

    For the purpose of using the Services, the User shall provide LOGISHAR the                  following information:

  • Business and personal contact information, such as your first and last name, email and mailing addresses, phone number, professional title and organizational name.

  • Content you choose to upload to the Service, such as text, images, audio, and video, along with the metadata associated with the files you upload.

  • Profile information, such as your username and password that you may set to establish an online account with us.

​

  • Registration information, such as information that may be related to a service, an account or an event for which you register.

​

  • Feedback or correspondence, such as information you provide when you contact us with questions, feedback, or otherwise correspond with us online.

  • Demographic Information, such as your city, state, country of residence, postal code.

​

  • Usage information, such as information about how you use the Service and interact with us, including information associated with any content you upload to the websites or otherwise submit to us, and information you provide when you use any interactive features of the Service.

  • Marketing information, such as your preferences for receiving communications about our activities, events, and publications, and details about how you engage with our communications

  • Other information that we may collect which is not specifically listed here, but which we will use in accordance with this Privacy Policy or as otherwise disclosed at the time of collection.

Personal Info may be collected, combined and used for the purposes of creating User accounts, contacting Users' contact person as part of our Services, using, maintaining and developing LOGISHAR’s Platform, contacting Users, providing services and products, sending User information to Authorized Users, conducting research and creating reports for internal use and Users' use.

If you are our User

​

In addition to the above, the Registration Data (defined below) may be provided for authentication and validation of a User’s business, as explained under the Terms of Use found at https://www.yashartrade.com/terms-of-use. Additional information may be required as well, in the process of such validation of User’s business, which is provided by a third party, https://sumsub.com/ (hereinafter: "Sumsub"). Such information may include Personal Information. By using the Platform, You hereby agree that any Personal Info may be processed and collected for the purpose of using the Platform, including the validation process, during which such information shall be transferred to Sumsub, and processed according to Sumsub’s terms of use and privacy policy, which may be found at https://sumsub.com/data-protection-policy/.

    2.2. Account, User and Authorized User Data

    For the purpose of using the Platform Services, you will have to create Your Account      and define Authorized Users. Such a User account is the Master Account, which            may require the User's details as:  User full name and Company number (if                    applicable), username, email address and phone number. Upon creating User's              master account, User may add and define Authorized Users. In such action User            shall provide us data directly and we will store such User and Authorized User Data      on our systems and use it for the purposes described in this Privacy Policy. User            Account-specific information may include (the “Registration Data”):

  • User full name and Company number (if applicable)

​

  • Authorized User first and last names;

​

  • User/ Authorized Users' email address;

​

  • Phone numbers

​

  • link to social media profile

​

  • A password for the master account and for each Authorized User; and

​

  • An Account number that is created in LOGISHAR’s Platform and used to identify each User.

  • Relevant Banking information

​

  • Photo

​

  • Job title

​

  • Identification number as applicable

    2.3. Cookies and Automated Information Collection

    We and service providers acting on our behalf, such as Google Analytics,                      Facebook Pixel, may store log files and use tracking technologies such as: cookies,      which are small pieces of data transferred to your computer for record-keeping              purposes; and local shared objects, also known as flash cookies, which help us to          reduce fraud, remember your preferences and speed up loading times.

    We and our service providers may use these log files, tags, and tracking                        technologies to collect and analyses certain kinds of technical data, including:

  • IP addresses;

​

  • the amount of time spent on particular pages and uses of LOGISHAR.

​

  • Facebook Pixel We will connect this data from your Account.

​

    2.4. User Communications and Support Correspondence

    When you ask for help from our User support team, we will collect and store the            contact information you provide them (generally, your name and e-mail address,            Authorized User to contact with), information about your activity on LOGISHAR, and      your Account details. We may also store the communications you have with the              User support team and any information in those communications in order to provide      support and improve LOGISHAR. In addition, any additional information provided in      the Deal Room (as defined in the Terms of Use) will be collected and stored as part        of the Deal process and the Deal log, which shall be archived once the Deal is done.      By providing us details in the Deal Room you agree to our use of such information          for the purpose of providing the Services including contacting you for promoting the        applicable deal until its consummation.

    2.5. Anonymous Information

    It is clarified that the information collected through the Platform regarding User              business belongs to you. With respect to Authorized Users Personal information            only – since LOGISHAR acts as the processor of the applicable User’s information,        any inquiry you may have regarding your information shall be referred to User and        handled by it.

    Notwithstanding the above, the Company may collect, use and publish Anonymous        Information (as defined below), and disclose it to third parties, for providing the              Services, improvement, publishing and marketing the Platform, Web Application,            and Services. "Anonymous Information" means information concerning the use of      the Web Application, LOGISHAR and the Services which does not allow                          identification of an individual, such as aggregated information and analysis on the          patterns of use of the Software and Services. The Company is the owner of all the        Anonymous Information collected or received by the Software, Services and Web          Application, all in accordance with the Terms of Use and the applicable SOW                  executed between the LOGISHAR and User.

3. LEGAL BASIS FOR PERSONAL INFO PROCESSING

    3.1. Service Agreement

    For the purpose of providing our Services, You must agree to accept LOGISHAR’s        Terms of Use, which can be found https://www.yashartrade.com/terms-of-use.                According to these Term of Use, we are obligated to provide each User - the                  Services (subject to the performance of User's duties under the Terms of Use).

    In light of the above and only if required, LOGISHAR processes Personal Info for          the performance of its duties under the agreements between the LOGISHAR and          the User. 

 

    For example, as mentioned above, User shall define Authorized Users in                        LOGISHAR for the purpose of using the Services. Per such Authorized User                  LOGISHAR will record and maintain Personal Information as: First and Last name,        username, email address and phone number. LOGISHAR may also contact User's        Authorized User in events of consummation of Transactions, Transaction                        Agreements (as such terms defined under the Terms of Use) or emergencies as part      of the Services.

    3.2. Legitimate interest

    LOGISHAR processes personal information due to legitimate interest as well: as            part of our Services we keep on developing, monitoring and analyzing all                        information received through the use of LOGISHAR. Such actions help us to                  improve LOGISHAR and our Services, offer new products and new services to you        as well as to change part of the Services in accordance with the use of LOGISHAR        by our Users. If you regard that your interests or fundamental rights and freedoms          override our legitimate interest and require protection of your Personal Info, please        don't hesitate to contact our person defined below.

    3.3. Consent

    Part of our process is done on the basis of your consent.

​

    If you are a User -You consent to provide us with information regarding emails,              Authorized Users, feedback as well as the use of cookies and other tracking                  technologies. Regarding the use of cookies and other tracking technologies –                please read our notice above on section 2.3.

    It is important for us to clarify that as a User you have the right to withdraw your              consent at any time by contacting our contact person detailed below.                              Notwithstanding, if you are a Authorized User or a User’s Client, any withdrawal            shall be taken care of according to User’s instructions, and such inquiry should be          referred to the applicable User. Please note that a withdrawal does not, however,          affect the lawfulness of processing based on consent before the withdrawal.

    3.4. Legal Requirements

    We may also process personal information as part of any legal requirement                    demanded of LOGISHAR. Such legal requirements may include data regarding              payments methods, invoices, charges, book- keeping and other obligations required      of LOGISHAR and its Services due to the applicable law. All data processed due to        legal requirements shall be stored and kept in accordance with the applicable law.

4. HOW WE USE THE DATA WE COLLECT

​

The main use of the information we collect and store is to provide the Services through our Platform to our Users, as well as providing a better service experience to all users of the Platform. Additional purposes for which we may collect and store your Personal Info include:

 

  • Provide, operate and improve the Service;

  • Provide information about our products and services;

​

  • Establish and maintain User profiles on the Platform and the Service;

​

  • Facilitate social features of the Service, such as by identifying and suggesting connections with other Users of the Service and providing chat or messaging functionality;

  • Communicate with you about the Service, including by sending you announcements, updates, security alerts, support and administrative messages. You will have the ability to opt-out of our marketing and promotional communications as required by law, an e-mail to customersupport@yashartrade.com, or follow the instructions set in our marketing material sent to you;

  • Communicate with you about events or contests in which you participate;

​

  • Understand your needs and interests, and personalize your experience with the Service and our communications;

​

  • Provide support and maintenance for the Service;

​

  • Respond to your requests, questions and feedback.

  • To monitor and analyze the use of the Services;

​

  • To protect LOGISHAR’s rights and property in connection with the Services;

​

  • To prevent fraud or potentially illegal activities, and to enforce the Terms of Use;

​

  • To comply with our legal obligations, resolve any disputes We may have with you or other Users, and to enforce our agreements with third parties;

  • To conduct research.

 

One important use of your information is communication. If you have provided your email address to us, We will use it to respond to User support inquiries, keep you informed of your activity, your account etc.

5. INFORMATION SHARED WITH YOUR ORGANIZATION

​

If you are a Authorized User of a User, and therefore use the Services for an organization, we may have access to your Personal Info and content and may use it subject to the applicable laws and agreements from time to time within the scope of the Terms of Use.

When processing your Personal Info collected and processed in LOGISHAR to which the User has access, the User acts as a controller of the data and you should direct any inquiries in respect of the use of your Personal Info by your User to the respective contacts of the User.

​

We shall not be held accountable for any misuse of your Personal Info or the failure to protect it.

 

6. HOW WE SHARE YOUR PERSONAL INFO TO THIRD PARTIES

    6.1 General

    We may disclose aggregated information (information about you and other users            collectively that is not intended to specifically identify you) and other non- Personal        Info about our users for industry analysis, demographic profiling, marketing,                    analytics, and other business purposes.

 

    Notwithstanding the foregoing, Personal Info may be disclosed to the following third      parties:

  • Service providers. We may share your personal information with third party companies and individuals that provide services on our behalf or help us operate the Service (such as Sumsub, User support, hosting, analytics, email delivery, marketing, and database management services).

  • Other Users. Once Users wish to consummate a Transaction, LOGISHAR may provide functionality that enables you to disclose personal information to other Users of the Platform and the Services. For instance, you may be able to maintain a profile of your business and Authorized Users, You may also be able to submit content to the Service (such as Offers, photos, and videos), and we will display your name, username, and a link to your profile along with the content you submit. We do not control how other Users or third parties use any personal information that you make available to other Users.

  • Professional advisors. We may disclose your personal information to professional advisors, such as lawyers, bankers, auditors and insurers, where necessary in the course of the professional services that they render to us, or under a consummation of Transaction, with your prior approval.

  • For compliance, fraud prevention and safety. We may share your personal information for the compliance, fraud prevention and safety purposes described above.

  • If required under any applicable law or regulation or order by competent authorities, or in order to enforce the Terms of Use and to investigate possible infringing use of the Services.

   Your Personal Info, and the contents of all of your online communications in the             Services (as well as of your Authorized Users and Clients) and between you and us       may be accessed and monitored by us or disclosed to a third party:

 

  • If you wish to enter or to consummate a Transaction;

​

  • If we, in good faith, believe that we have to disclose the information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements, or legal process (for example, a court order, search warrant or subpoena);

​

  • To satisfy any laws or regulations that apply;

​

  • Where we believe that the Services are being used in committing a crime, including to report such criminal activity or to share information with other companies and organizations for the purposes of fraud protection, credit risk reduction, and other security precautions;

  •  If we, in good faith, believe that there is an emergency that poses a threat to the health and/or safety to you, another person or the general public; and

​

  • If we become involved in a merger, acquisition, or any form of sale of some or all of our assets.

​

  • To protect the rights or property of LOGISHAR and applicable third parties, including to enforce the Terms of Use.

 

    6.2. Third-Party Service Providers

    In addition to Sumsub as described in Section 2.1 above, LOGISHAR may share            your Personal Info with third-party companies to perform services on our behalf,            such as analyzing data, hosting services or User support and service. We                      contractually require these third-party service providers to maintain the                            confidentiality of the information we share with them, and we contractually require          them to comply with applicable data protection laws as well as to not use your                Personal Info for anything other than to provide services on our behalf.

 

    YOUR RIGHTS: HOW TO ACCESS, UPDATE AND MANAGE YOUR                            INFORMATION

​

    As a User, you have a right to access, update and manage your own Personal Info        under the applicable data protection laws. Since LOGISHAR is provided as a SaaS        solution – as a User you may access / alter / delete all Personal Information                    recorded in LOGISHAR, according to your own discretion (and such Authorized              User applicable permissions). If you have any problem to exercise any of the rights        defined below, please email us at customersupport@yashartrade.com.

    Please note, if you are an Authorized User or a User’s Client, and you want to                review, delete, or change the Personal Info processed by the User, through our              Platform, please contact the User directly.

​

    We may ask you to provide further information in order to identify you. We will                respond to your requests within 30 days.

​

    6.3. Accessing and Updating Your Personal Info

    As a User, you are able to access and update all information about you in                      LOGISHAR under your own control. You are also entitled to obtain confirmation from      LOGISHAR on whether or not we process Personal Info about you. You may also          have information on our means of processing as well as a copy of the Personal Info      undergoing processing. We may charge a reasonable fee based on our                          administrative costs if you request further copies.

    As mentioned above, if you are an Authorized User, and you want to access or              update your Personal Info processed by the User, through our Platform, please              contact the User directly.

​

    6.4. Right to rectify your data

    As a User, you shall have the right to obtain from us without undue delay the                  rectification of inaccurate Personal Info concerning you. You may have your                    incomplete data completed if you provide us with additional information                          or statements.

​

    As mentioned above, if you are an Authorized User, and you want to obtain your            Personal Info processed by the User, through our Platform, please contact the User      directly.

​

    6.5. Right to erasure

    As a User, if you no longer want us to actively process your Personal Info, you can        have us delete your Personal Info if:

​

  • Your Personal Info is no longer necessary in relation to the purposes for which they were collected or otherwise processed;

​

  • If you withdraw your consent;

​

  • If you object to the processing and there are no overriding legitimate grounds for the processing;

​

  • The Personal Info have been unlawfully processed; or

​

  • The Personal Info has to be erased for compliance with a legal obligation in applicable law.

​

    If you no longer want LOGISHAR to make active use of your Personal Info, you may      send an e-mail to customersupport@yashartrade.com. Such e-mail shall include            "Delete My Account" in the subject line, your first name, last name and e-mail                address in the body of the e-mail. Please note that certain records, for example              those relating to payments or User service matters, will be held for legal and                  accounting purposes.

    As mentioned above, if you are an Authorized User, and you want to delete your            Personal Info processed by another User (such as a seller, buyer or broker), through      our Platform, please contact the User directly.

​

7. PRIVACY POLICIES OF LINKED THIRD-PARTY SERVICES

​

Our Software and Services may contain links to third-party services, which are companies other than LOGISHAR that may direct to their own websites, online services or applications. We are not responsible for the privacy practices or the content of these third-party services. If you have any questions about how these third-party services use your information, you should review their policies and contact them directly.

8. TRANSFERS OF DATA

​

We may transfer your Personal Info to affiliated entities or to other third parties outside of Israel, as described in this Privacy Policy.

​

We ensure that a legal basis for such a transfer exists and that adequate protection for the Personal Info is provided as required by applicable law. We use standard contractual clauses and require that the receiving party uses appropriate technical and organizational information security measures.

9. INFORMATION RETENTION POLICY

​

We will not retain your Personal Info for longer than is necessary for the defined purpose of the processing of Personal Info or for legal requirements. For instance, we may retain some information for a few years after you have closed your Account if this is necessary to meet our legal obligations or to exercise, defend or establish legal rights. Certain records, for example those relating to payments, will be retained for accounting purposes for a minimum of six years after the end of the year during which the financial year ended. Information that is not under legal obligation to be retained may be destroyed 7 years after the deletion of the account, unless You instruct us otherwise. Nevertheless, your feedback regarding LOGISHAR may be retained for longer periods, unless you asked us to remove them.

Notwithstanding, since the User is the Controller of any information of the PermittedAuthorized Users, any such information shall be subject to the applicable CustomerUser’s policies regarding duration of record keeping, and such inquiries shall be handled by it and to be referred directly to CustomerUser.

10. SECURITY OF YOUR INFORMATION

​

We implement technical and organizational security measures to help protect the security of your Personal Info both online and offline. We follow generally accepted industry standards to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of Personal Info. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Info, we cannot guarantee its absolute security.

  • We strive to maintain the reliability, accuracy, completeness and currency of Personal Info that we collect and to protect the privacy and security of our users. We keep your Personal Info only for as long as reasonably necessary for the purposes for which it was collected or to comply with any applicable legal or ethical reporting or document retention requirements.

  • We limit access to Personal Info about you to employees, contractors and agents who we believe reasonably need to come into contact with that Personal Info. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

  • We have physical, electronic, and procedural security measures and safeguards to reasonably protect Personal Info. Our servers and our databases are protected by industry standard security technology, such as industry standard firewalls and password protection.

  • We use AWS' and Google's services in order to perform the Services, including providing the software and processing all information through it. Such service providers provide high industry standards with regards to measures of security. For Google's privacy policy go to https://policies.google.com/privacy?hl=en-US. In the event we wish to change such subcontractors we shall strive to receive the services from a service provider who adheres and applies suitable measures in accordance with the applicable law. 

  • Although we cannot guarantee against any loss, misuse, unauthorized disclosure, alteration or destruction of data, we try to prevent such unfortunate occurrences.

  • Your Account information is protected by the password you use to access your Account. It is important that you protect and maintain your Account's security and that you immediately tell us of any unauthorized use or suspected unauthorized use of your Account. If you forget the password to your Account, LOGISHAR allows you to request that instructions be sent to you that explain how to reset your password.

11. RESIDENTS OF THE EUROPEAN ECONOMIC AREA (“EEA”)

​

If: (a) you are established in the European Economic Area (EEA); (b) you provide goods or services to Users in the EEA; or (c) you are otherwise subject to the requirements of the EU General Data Protection Regulation, LOGISHAR is subject to the Israeli Law and its regulations. We do not process the information according to the General Data Protection Regulations applied in such areas and you and your Clients should not use our services.

Notwithstanding, if you are located in the EEA, and you have decided to use LOGISHAR services, you have certain rights under European law with respect to your personal data, including the right to request access to, correct, amend, delete, or limit the use of your personal data. If you are a User or a visitor of LOGISHAR websites, or a user of LOGISHAR Platform and wish to exercise these rights, please reach out to us using the contact information below. Nevertheless, please note that as a Client of our User or as a Authorized User - we serve as a processor on Users behalf, and can only forward your request to them. Therefore, you should interact with such Users directly and allow them to respond.

Additionally, if you are located in the EEA, we note that we are generally processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above, unless we are required by law to obtain your consent for a particular processing operation.

12. CHANGES TO THE PRIVACY POLICY

If we decide to make material changes to this Privacy Policy, we will inform you, your Authorized Users by placing a notice on www.yashartrade.com, or by sending you a notice to the e-mail address we have on file for you prior to the change becoming effective. We may supplement this process by placing notices on other LOGISHAR Software. You should periodically check www.yashartrade.com and this Privacy Policy for updates.
